All kinds of resale will be seen as commercial use and priced differently from my regular pricing. This applys to any kind of use where you are selling a product with the art you commissioned included in some way.Marketing
While marketing is technically part of commercial use, I do not see it as relevant for indie creators and small businesses for my commisisons. You can not use my art to promote your own commissions or art in a misleading manner. If you represent a bigger company, I will however see marketing as a part of commercial use.Examples of accepted marketing use: Creator promoting their live stream or appearance somewhere. An event using it in their guide signs.Examples of margeting use that's NOT accepted without commercial rights: An even using it as their key art. A creator using it on their merchandise.Basically...
If you are in any way selling any part of my art, we will have to discuss commercial use for the pricing.
If you are using it in marketing, the commercial price will apply only if it's significant or you are representing a bigger company.How do I price commercial use?
This depends on the use and scale of it. For example, if I design you a mascot, I will have to take into account all use beyond the art I made.
If you are commissioning a design for merchandise, it will depend on the scale of the operation. It will also depend on the contract.Be open about your budget from the start! We can see what kind of deal works best for your situation.
